GENERAL
I have the right to refund a commission and cancel your service due to rude or otherwise distasteful behaviorIf I reject a commission I do not have to disclose the reasons why as there are some things I am not comfortable with illustrating.I am willing to draw almost any type of character/creature. In the event of misrepresenting your subject, please communicate these errors with me before completing the piece.I will not accept commissions that utilize AI reference images or any other imagery referencing harmful materials.Do not edit or trace commissioned work. If revisions are required please view the appropriate section detailing this process.Be aware that I accept up to five commissions at a time. If you are not receiving an update it is because you are either further back in the queue or I am on a temporary break.In the case of a strict deadline, clearly communicate this with me and provide both payment and the date of said deadline. (See DEADLINES AND DELIVERY)Breaches of my TOS will result in unappealable blocks and refusal to work with you.PAYMENTS
A 50% downpayment is required to begin the commission. This down payment is non-refundable once work on the rough draft has commenced, except in cases where the agreed upon deadline is missed by the artist without prior written agreement.The final payment is expected once the final sketch is approved by the client. Failure to provide this payment will result in prematurely finishing the service and no refunds will be provided for the initial down payment.REVISIONS
During the process of completing the commission, revisions may be asked for.
Up to two rounds of major revisions during the initial rough draft stage are included. After the rough draft is completed and approved there will be one more sketch phase to request up to three minor revisions. Any additional edits or major re-sketches beyond these will incur an extra fee.Once the sketch has been given final approval, large changes to things such as overall composition may be impossible to provide. Large changes such as posing, line art, colors, and rendering will come at an additional charge up to 30% after the steps that solidify these features are completed and were previously given approval.DEADLINES AND DELIVERY
At minimum, deadlines can be set two months after the down payment for a commission is provided. To request a rush order an additional 30% will be charged alongside the initial payment for the commission. This deadline can be no shorter than two weeks.Every commission will be completed within a three month window unless communicated otherwise, there is no additional fee to this soft guarantee.In the case of a client taking longer than 7 business days to approve a draft or respond to a request, the final completion deadline will be extended accordingly.USE
The artist retains full copyright ownership of all created artwork unless a commercial release/license is explicitly purchased in writing.Adoptables and other custom designs may be resold, however, if no additional content is provided with the original deliverables, you may not resell for higher than the original price.If an adoptable/custom design has been listed for resale, provide original credits to the design and specify that it is being resold.Under no circumstance is my work allowed for AI training, NFTs, or other Crypto usage.INTELLECTUAL PROPERTY RIGHTS
Characters drawn by me retain their original ownership.You reserve the right to use commissioned artwork for self promotion and non profit content creation. However, modifications to commissioned work under this license is still not permitted outside of previously described clauses.I reserve the right to use any commissioned work for purposes of portfolio, art books, speedpaints, tutorials, and other social media content unless a privacy fee has been paid.When publicly reposting artwork in public spaces, credit me when possible (via the appropriate @ on their respective social media platform or by my brand name "Sephirotten").I reserve the right to use artwork of characters that do not belong to the client for merchandise, prints, and other self promotion.REFUNDS
In the event of no prior communication on refunds or deadlines from either party, clients may request their refund after one month has passed with no updates.If updates/progress have been provided and a refund has been requested, a 50% refund will be issued.COMMUNICATION
